  • When are criminal background checks required and on whom?

Criminal Background checks are required BEFORE an individual is hired (new hire), transferred, promoted or is reclassified (current employee) into a new position that has been designated as a security sensitive position. Typically, the criminal background check is requested at the point where a finalist for a position is identified. No offer of employment should be made until the results of the background check are completed and reviewed by the hiring official or the Vice President of the department.

  • How is the determination made regarding the designation of security sensitive positions?

The UT System Business Process Memorandum, 29-04-03 and the UTSA HOP Policy 4.30 contain the guidelines and criteria. Management (The President of UTSA along with the Provost) interprets this guidance and makes a judgment call that they feel is in the best interest of UTSA.

  • How do I know which positions are security sensitive?

The President has determined that all jobs at UTSA are currently security sensitive.

  • When should the Criminal Background Check (CBC) process be initiated?

The CBC should be initiated when, through the normal hiring process, a finalist for a security sensitive position is identified. Before extending an offer, the department and the finalist must complete the CBC request form. The form is sent to the UTSA Police; they complete the investigation and notify the hiring official or the Vice President of the results. Only after the results are reviewed and a hiring decision is made can an offer be extended to the individual.

  • Where is the Criminal Background Check request form located?

On the UTSA Human Resources web site at: http://www.utsa.edu/hr/CriminalBackground/criminalbackground.cfm

  • Should I include comments in the DEFINE appointment transaction indicating that a Criminal Background check was conducted or include a statement regarding the outcome, e.g., CBC Negative?

Absolutely Not. There should be no reference of any sort in any section of DEFINE regarding security sensitive positions nor should there be any comments referring to the results of Criminal Background checks. The CBC information is confidential and the UTSA Police department is the official office of record for all information regarding Criminal Background Checks.

  • Do individuals under the age of 18 require a CBC?

No.

  • Where do I send the form?

  • Who appoints the Hiring Officials, what are their responsibilities and where can I find out who they are?

The Hiring Official(s) are responsible to ensure compliance with the Criminal Background Check policy as defined in the UT System BPM and UTSA HOP Policy 4.30. The Department Vice President appoints them.

  • Is a Criminal Background Check required for an individual returning after a brief break in service?

If a previously terminated individual returns to the identical same job (same job code and same department) within four months of separation, a Criminal Background Check will not be required.
