Computer Security Handbook, Part 4 - Legal Sanctions and Laws

Sanctions

The University reserves the right to remove or restrict the use of its computers, or networks or other information resources when applicable University policies or codes, contractual obligations or state or federal laws are violated. The University may also limit access to material posted on University-owned computers in response to violations. Further, the University is obligated to report any violations of state or federal law, as it discovers them, to the appropriate authorities. Electronic mail messages, Web pages or other electronic files originated on University-owned computer or sent over University network systems do not necessarily reflect the view of UTSA, its officers, directors or management:

  • Employees with evidence of policy or law violations should report those violations to the administrator in charge of their respective division or department.
  • University administrators with evidence of violations should present them to the Associate Vice President for Information Technology.
  • Students with evidence of violations should present complaints to the Office of Student Judicial Affairs.
  • Concerns about the health or safety of individuals threatened or harassed through electronic mail should be addressed to the University Police. Concerns about the physical integrity of computers or network systems should be addressed to the Office of Information Technology.
  • Concerns about violations of communications policies should be addressed to the Office of University Communications.

For those who feel they haven't been punished enough already and wish to read the specific laws, rules, standards, and policies, the following are the directives that this manual is based on:

  • Texas Penal Code, SECTION 1. Title 7, Chapter 33, "Texas Computer Crimes Statute"
  • Texas Administrative Code, Title 1, Part 10, Chapter 202, "Information Resource Standards"
  • Department of Information Resources, Information Resources Security and Risk Management Policy, Standards, and Guidelines
  • UT Systems Business Procedures Memorandum 53-02-96, "Policy for the Use and Protection of Information Resources"
  • UTSA Handbook of Operating Procedures, 8.12 - "Electronic Communications using University Computers and Networks at the University of Texas at San Antonio" and 8.13 - "The Organization and Appropriate Use of the Internet at UTSA".
