Attorney general clarifies state retirement eligibility options

(Aug. 6, 2003)--The Texas Office of the Attorney General has issued an informal opinion letter concerning recent legislation regarding retirement options and medical benefits.

The informal opinion letter clarifies that the new eligibility requirements imposed by SB 1370 do not apply to individuals who are employed by the UT System as of August 31, 2003, or who are eligible to participate as a retired employee of the UT System as of August 31, 2003.

This means that if you are employed by the UT System or are eligible to participate as a retired employee as of Aug. 31, 2003 -- you are required to meet only the following requirements:

Current employees who retire after September 1, 2003, will not be required to have a total of 10 years of UT System or state service and will not be required to be either 65 or meet the "rule of 80" (age plus years of service) to be eligible for retirement insurance benefits. However, individuals who begin employment on or after September 1, 2003, will still be required to meet these new requirements.

Vice President for Business Affairs David Larson, who originally planned to retire at the end of the current fiscal year before the opinion letter was issued, has agreed to remain at UTSA through April 30, 2004.

"I look forward to continuing my working relationship with President Ricardo Romo and overseeing important projects that are at various stages of development," Larson said.

"David Larson's leadership in business affairs is crucial at this point in the university's development," Romo said. "We are undergoing some of the largest building projects in the institution's history during a time of unprecedented fiscal austerity. Mr. Larson leads a very talented team who have kept us on a sound financial course and enabled UTSA to maintain or expand programs for students, faculty and staff."
