Legislature implements status change for return-to-work retirees

The 79th Legislature passed HB 3540, which includes provisions that affect employees who retire and return to work. Specifically, HB 3540 provides a “new employee” benefit status to all return-to-work retirees hired on or after June 1, 2005. The “new employee” status means accrual of longevity pay, vacation leave, benefit replacement pay (BRP) and hazardous-duty pay now is based on the "new" post-retirement hire date. Previously, if an employee returned to employment within one year he or she would accrue vacation time based on previous years of state service and the original employment date, collect longevity pay based on those years of service and still have BRP, the portion of Social Security paid by the state. HB 3540 does not affect return-to-work employees who retired before June 1, 2005.
