Section I: General Provisions
1. General
These Parking and Traffic Rules and Regulations are established pursuant to Sections 51.201 et seq., 54.005, 54.505, 65.31, and 71.04 of Title 3 of the Texas Education Code and the Rules and Regulations of the Board of Regents of The University of Texas System. Their purpose is to regulate parking, traffic, and the use of university parking facilities; provide for the issuance and administration of parking permits; and establish jurisdiction over parking and traffic violations.
These regulations apply to all individuals who operate, park, or otherwise bring a vehicle onto university property. They supplement applicable ordinances of the City of San Antonio and the laws of the State of Texas governing pedestrians, bicycles, and motor vehicles.
The operation and parking of motor vehicles on university property is a privilege granted by the university and not an inherent right of any faculty member, staff member, student, or visitor. All faculty, staff, students, and visitors who park a motor vehicle on university property must have a valid university parking permit or utilize designated paid parking options. A parking permit grants the privilege of parking in authorized areas but does not guarantee the availability of a parking space.
The university assumes no liability or responsibility for damage to or theft of any vehicle parked or driven on campus. The university assumes no responsibility or any duty to protect any vehicle or its contents at any time the vehicle is operated or parked on the campus. The issuance of a parking permit or the granting of parking or operating privileges does not create a bailment relationship between the university and the vehicle owner or operator. The university assumes no responsibility for the care, custody, protection, or security of any vehicle or its contents while on property owned, leased, or otherwise controlled by the university.
These regulations are in effect at all times on university property.
2. Administration and Enforcement of these Regulations
A. The University Standing Committee on Parking and Traffic
The University Standing Committee on Parking and Traffic is composed of twelve voting members consisting of a minimum of four faculty, four staff members, and four UT San Antonio Academic Campus students. One representative each from People Excellence, Facilities, Alumni, and the University Police Department serve as an ex officio. Appointment of the Committee members will be consistent with current university policy. Faculty/staff members shall serve two-year terms and student members will serve one-year terms. The charge is to review operational guidelines and to make recommendations to the development and revision of parking and transportation regulations necessary to support an efficient parking and traffic system.
B. University Parking Appeals Panel
The University Parking Appeals Panel is composed of faculty, staff, and student representatives. The panel is responsible for reviewing parking citation appeals and rendering final decisions. The panel may uphold the citation or reduce a citation to a warning. A final decision requires a majority vote and participation from at least one faculty representative, one staff representative, and one student representative.
C. Campus Services
Campus Services is responsible for the administration and enforcement of university parking and transportation regulations. Responsibilities include the issuance of parking permits; management of parking facilities; assessment and collection of parking violation fees; establishment of citation appeal procedures; processing of parking citation appeals; and oversight of parking enforcement operations. Campus Services supervises personnel authorized to enforce parking regulations and issue parking citations.
D. The University of Texas at San Antonio Police Department (UTSAPD)
UTSAPD is authorized to enforce these regulations at any time or under any circumstances deemed necessary by UTSAPD. UTSAPD officers may issue university citations or court appearance citations enforceable in municipal court.
3. Authority
Campus Services and UTSAPD are authorized to enforce university parking and transportation regulations through the following actions:

Issuance of parking and traffic citations; assessment and collection of enforcement fees, billing of outstanding citations; and referral of delinquent accounts to authorized collection agencies, as permitted by university policy and applicable law.

Immobilization, relocation, or impoundment of vehicles that create a safety hazard, obstruct the movement of vehicular, bicycle, micromobility, or pedestrian traffic, or block access to sidewalks, accessible parking spaces, loading docks, ramps, crosswalks, entrances, exits, fire lanes, drive aisles, or other restricted areas.

Immobilization, relocation, or impoundment of vehicles with outstanding enforcement fees or those displaying lost, altered, fraudulent, fictitious or stolen parking permits or credentials, following appropriate notice and due process.

Suspension, revocation, or denial of parking privileges, parking permits, garage access privileges, or other university mobility privileges for individuals who fail to comply with these regulations or have outstanding charges.

Requiring a vehicle owner, operator, permit holder, or responsible party to appear before an appropriate court, university official, or hearing body regarding violations of these regulations.

Application of administrative holds or other university-approved actions for non-payment of outstanding charges, in accordance with university policy and applicable regulations.

Referral of violations for student conduct or employee disciplinary review when warranted by the nature and severity of the violation.

Utilization of other lawful enforcement measures commonly employed by institutions of higher education, governmental entities, or public agencies to support compliance with parking and transportation regulations.
4. Presumption of Responsibility
The issuance of a citation reflecting the existence of any parking or traffic control device, sign, marking, signal, restricted area, or paid parking space on university property shall constitute prima facie evidence that such device, sign, marking, signal, or restriction was officially authorized and in effect at the time of violation.
When a vehicle is cited for a violation of these Parking and Traffic Rules & Regulations, proof that the vehicle displayed a valid university parking permit at the time of the violation shall constitute prima facie evidence that the permit holder was responsible for the vehicle’s parking or operation.
If the vehicle did not display a valid university parking permit, proof that the vehicle was registered to an individual constitutes prima facie evidence that the registered owner was responsible for the vehicle’s parking or operation.
5. Responsibility for Citations

The individual to whom a university parking permit is issued is responsible for citations issued to any vehicle displaying that permit or registered to that individual through Campus Service.

If a vehicle does not display a valid university parking permit and is not registered through Campus Services, responsibility for the citation rests with the registered owner of the vehicle as identified through applicable motor vehicle registration records. If the owner is affiliated with the university as an employee, student, or permit holder, the university may assess the citation and any associated fees to that individual.
6. Collection Methods
The university may utilize one or more of the following methods to collect outstanding parking permit fees, citations, and other charges authorized under these regulations:

Payroll deduction, when authorized by the employee, for the purchase of parking permits. Employees are responsible for ensuring that permit payments are completed and for resolving any missed deductions or outstanding balances.

Administrative holds or other university-approved collection actions for students with past-due parking-related charges, in accordance with university policy.

Referral of delinquent accounts to authorized collection agencies, attorneys, or other third-party collection services. Additional fees may be assessed as permitted by law and university policy.

Denial, suspension, or withholding of parking permits, parking privileges, or access credentials for individuals with outstanding balances or vehicles subject to enforcement actions under these regulations.
