The University of Texas at San Antonio is committed to maintaining an educational and working environment that is free from discrimination on the basis of sex and free from sexual misconduct in accordance with Title IX, Title VII, and other state and federal laws.

This past legislative session, the State of Texas passed SB 212 and HB 1735, which contain state provisions impacting Title IX and sexual misconduct-related institutional processes effective starting the 2019-2020 academic year.

SB 212 imposes new requirements on all employees to report incidents of sexual misconduct. Specifically, under SB 212, an employee of the institution who, in the course and scope of employment, witnesses or receives information regarding an incident that the employee reasonably believes could constitute sexual harassment, sexual assault, dating violence, or stalking is required to report promptly to the Title IX Coordinator (see contact information below) all information known that is relevant to an investigation. In addition, employees of the institution are considered responsible employees under HOP Policy 9.24: Sexual Harassment and Sexual Misconduct.

A Responsible Employee is a University employee who has the duty to report incidents of and information reasonable believed to be sexual misconduct to the Title IX Coordinator (or designee), or an employee whom an individual could reasonably believe has this duty.  

Under HOP Policy 9.24, sexual misconduct includes, but is not limited to:

  • sexual harassment,
  • dating violence,
  • domestic violence,
  • stalking,
  • sexual assault,
  • sexual exploitation, and
  • any other inappropriate, or unwelcome conduct of a sexual nature.

Under SB 212, an employee who fails to report an incident of sexual harassment, sexual assault, dating violence, or stalking may be subject to criminal offense (misdemeanor) and, in accordance with the University’s disciplinary procedure in a policy violation of failing to report, the University is required to terminate the employee’s employment.

Over the next few months, additional information will be provided to the campus community, and you will see updates to relevant policies and employee training.

Currently, the Texas Higher Education Coordinating Board (THECB) is tasked with administrative rule-making regarding the implementation of the new laws. Once this process is completed, we will have a clearer picture for institutional implementation.
