Emergency Paid Sick Leave Eligibility Extension

On March 11, 2021, the American Rescue Plan Act (ARPA) extended the Families First Coronavirus Response Act. While the extension is voluntary for employers, UTSA is extending the Emergency Paid Sick Leave (EPSL) to employees. The extension under ARPA begins April 1, 2021, and expires on September 30, 2021.

Below are the details about the program and expanded criteria. Beginning April 2021, employees meeting the criteria can complete and submit an EPSL application online.

What is EPSL?

Emergency Paid Sick Leave (EPSL) provides paid sick leave (80 hours for full-time employees; prorated for part-time employees) when an employee is unable to work (or telecommute) due to a need for leave because the employee meets one or more of these conditions:

    • Subject to a federal, state or local quarantine or isolation order related to COVID–19
    • Under self-quarantine due to concerns related to COVID-19 based on the advice of a health care provider
    • Experiencing symptoms of COVID-19 and seeking a medical diagnosis
    • Caring for an individual who is subject to an order as described in subparagraph (1) or has been advised as described in paragraph (2)
    • Caring for a son or daughter of any age whose school or place of care has been closed or whose childcare provider is unavailable due to COVID-19 precautions
    • Experiencing any other substantially similar condition specified by the Health and Human Services secretary in consultation with the Treasury and Labor secretaries

    The April 2021 extension includes the additional conditions below:

    • Seeking or awaiting the results of a diagnostic test for (or a medical diagnosis of) COVID-19 after an exposure to the virus or test or diagnosis at the employer’s request 
    • Obtaining immunization related to COVID-19 
    • Recovering from any injury, disability, illness, or condition related to a COVID-19 immunization.

UTSA Authorized Leave

A benefits eligible employee is defined as one who is employed to work at least twenty (20) hours per week for a period of at least four and one-half (4-1/2) months, excluding students employed in positions which require student status as a condition for employment. Faculty members appointed on a nine-month basis at least half time or more for a period of four and one-half months or longer are eligible to accrue sick leave, under the same provisions applicable to other University employees. Military Family Leave

    • Up to 12 weeks of leave because of  "any qualifying exigency".
    • Up to 26 weeks of leave in a single 12 month period to care for a service member.
