2.16 Acceptance of Money from Students 


I. POLICY STATEMENT


This policy supports UTSA’s core value of integrity and its initiative to ensure affordability. It defines parameters related to acceptance of money by teaching staffs from students for instructional purposes.


II. RATIONALE


This policy provides for compliance with the Rules and Regulations (Rule 31004, Section 9) established for The University of Texas System by the Board of Regents concerning acceptance of money from students.


III. SCOPE


All UTSA faculty and staff of the rank of instructor or above will be affected by this policy.

VIII. RESPONSIBILITIES


  1. Faculty
    1. Are aware of and understand UTSA's policy regarding acceptance of money from students.
  2. Office of the Provost and Vice President for Academic Affairs
    1. Reviews and approves the acceptance of pay by students for extra class instruction or coaching.
  3. Office of the Vice President for Development and Alumni Relations
    1. Manages gift contributions by students and/or relatives on behalf of UTSA.

IX. PROCEDURES


  1. Members of UTSA teaching faculty at the level of instructor or above, without previous and special approval of the UT System Board of Regents, shall not collect from students any fees or charges to be expended for instructional purposes and shall not sell to students books, notes, or similar student supplies.
    1. A member of the faculty or staff of UTSA of the rank of instructor or above may not accept pay or other monetary considerations for extra instruction or teaching of students registered in the institution where he or she is employed.
    2. With written approval of the Provost and Vice President for Academic Affairs, teaching assistants and other like instructional employees below the rank of an instructor may accept pay from students for extra-class instruction or coaching but only in courses or sections of courses with which they have no instructional connection.
  2. Gifts by Students and/or Relatives
    1. Solicitation
      1. Faculty or college administrators with teaching or administrative responsibility in the area of academic study the student is pursuing may not solicit contributions from the student(s) or their families.
      2. Contributions can be solicited by a development officer or other university administrator provided that the proposed request is first approved by the Vice President for Development and Alumni Relations or his/her designate
      3. Upon graduation, the former student and his/her family may be solicited in the same manner as all other alumni and acceptance of gifts will be subject to general gift acceptance policies.
  3. Receipt of Contribution
    1. Contributions given to the University or areas other than the area of study being pursued by the student may be accepted, provided they meet general acceptance requirements.
    2. Contributions made to the area of study may only be deposited in University accounts controlled by an administrator who does not have direct influence over a student's academic progress at the time the contribution is made. All contributions are to be processed for deposit by the office of Operations and Advancement Services.
